Terms of Use

These terms apply to the website at newcastleforge.com and to applications published by Newcastle Forge LLC, including Podland.

Your licence

Newcastle Forge LLC grants you a personal, non-exclusive, non-transferable licence to install and use our applications on devices you own or control. The software is licensed, not sold. You may not redistribute, resell, reverse engineer, or attempt to extract source code from our applications, except where that restriction is void under law that applies to you.

Applications obtained through the App Store or TestFlight are also subject to Apple's terms, which apply alongside these.

Podcast content

Podland is a player. It does not host, produce, or curate podcasts. Feeds and audio are delivered by the publishers and hosting providers you subscribe to, and remain the property of their respective owners. Newcastle Forge is not responsible for the availability, accuracy, or content of any podcast you choose to add, and adding a feed does not imply we endorse it.

Acceptable use

Do not use our applications to infringe copyright, to break the law, or to interfere with the operation of a third party's servers — for example by using the app to hammer a podcast host with automated requests.

Beta software

Applications distributed through TestFlight are pre-release. They may contain defects, may lose data, and may change or be withdrawn without notice. Use them with that understanding.

Warranty and liability

Our applications and this website are provided "as is", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Newcastle Forge LLC is not liable for indirect, incidental, or consequential damages arising from your use of our software, and our total liability is limited to the amount you paid us for it.

Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as the law permits, and your statutory consumer rights are unaffected.

Changes

We may update these terms. The date at the top of this page shows when they last changed. Continuing to use our software after a change means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict of laws rules.
